Higher Studies Policy 2006

Subject: Policy Regarding Higher Studies for Doctors in the Department of health and Medical Education and PGIMS, Rohtak.

Kindly refer to Government Memo No. 18/94/96-1HBI dated 26.04.2002 on the subject noted above.

The matter has been reconsidered by the government. Keeping in view the shortage of Specialist doctors in various streams in the Department, it is felt that the existing policy be revised. Accordingly the policy cited as subject have been modified as under.


A. General

1. HCMS/HMES Doctors serving to connection with the affairs of the State Government in the Health Department or those serving in the PGIMS Rohtak may be allowed to apply for seeking admission in various academic course leading to PG diploma/PG Decree/Super Specially courses in their respective streams of Medical Profession for which they will have to apply for and avail study leave under the relevant rules.

2. Permission to go in for Higher Studies to the in service candidates is not a matter of Right. It will be subject to specific approval by the government which will depend upon various factors i.e. possibility to spare one’s services without adversely affecting the larger public interest, the felt needs for specialists in various discipline on the basis of a review carried out from time to time and other exigencies of service.

3. The study leave in the first year will be granted on full pay (without allowances) and for the second year only hall pay (without allowances) will be allowed.

4. The adhoc service followed by regular service and counted for the purpose of increment shall be taken into account while calculating the requisite length of service.

5. A candidate keen to go for Higher studies but who does not fulfill the prescribed length of service as required for study leave will have to resign for the purpose of pursuing Higher Studies.

6. Study leave shall not ordinarily be granted in case of an employee who is due to retire or has the option to retire from govt. service within five years of the date on which he is expected to return to his duty after completion of his course.

7. The requisite length of service shall be calculated as to the last date of submission of application for the relevant courses (s).

8. The period of study leave kind due for the purpose of higher studies as admissible under the rules, shall court as service for all purposes subject to condition of successful completion of the course of study within the prescribed period. The period of EOL taken for the purposes of Higher Studies may also be allowed to count towards service for the purposes of increments and pension and is at the discretion of the competent authority.


B. Procedure :

The procedure for availing of the opportunity of Higher studies under the policy would be as under :


1. In the first instance, the Doctor concerned shall have to apply for “No objection certificate” (NOC) form his employer for submitting/forwarding his application to the institution concerned for admission to the course of study.

2. Once the NOC is issued by the employer, the process of admission will be regulated in accordance with the admission rules of the institution/university concerned.

3. After the candidate receives intimation regarding his admission to the said approved course of study, he shall submit an application for grant of sanction of leave as per entitlement. The said candidate will be allowed to relieve from his duties so as to enable him to join the course of study only after the leave is sanctioned by the competent authority and the formalities of bank guarantee as required under rules/instruction are fulfilled.

C. Sponsorship of the candidates for Higher Studies against reserved seats.


Presently, certain number of seats are reserved in the PGIMS Rohtak for PG Diploma/PG Decree courses for the in service employees of HCMS. The cases of in services candidates for Higher studies against reserved seats will be regulated as follows:


1. Candidates keen to go in for Higher Studies for the PG Diploma/PG Degree courses against the reserved seats will be required to apply for a “No Objection Certificate” to the Competent authority before submitting their application for admission to the said courses. Only those candidates will be considered for NOC under this category who fulfill the following conditions.

i) He/She must have completed the probation period successfully and completed three years service under the State Government including the probation period out of which two years service should be in rural areas.

ii) There should be nothing adverse against his integrity and efficiency.

iii) His service can be spared by the employer for the duration of course without adversely affecting the larger public interest.

iv) In addition to the above, if a Doctor has already studied for a PG Diploma course in any subject under the government Scheme as an in service candidates, he will be considered for grant of “No Objection Certificate” only for the PG Degree course in that very discipline subject provided he has completed the period of bank guarantee/bond period while proceeding for diploma course.


v) The in-service candidate, who already has PG Degree to their credit in any subject and want to do a diploma course in the same subject or in any other subject, will not be considered for issuance of NOC.

vi) A Doctor who has completed a PG Diploma course in any subject and wants to go in for PG Degree course in a subject other than the one in which he has done the diploma, will not be considered for “No Objection Certificate”.

2. After the NOC is issued to the applicant, his admission will be governed by the rules of institution/university. However, the candidate will have to appeal in the entrance test conducted for admission to the relevant course and obtain minimum 50% marks in order to be eligible for admission to the course.

3. Once the candidate sponsored against the reserved seats and succeeds in getting admission to the said course, he will required to take the following steps.

(i) he will have to apply for the study leave/leave of kind due for duration the course of study. The leave period will be considered for the duration of the course by the competent authority.

(ii) Consequent upon sanctioning of leave and before his relieving from the department, he/she will have to submit a bank guarantee of 7 lacs in case of case of Degree course /Super Specialty course and Rs. 5 lacs in case of Diploma Course. He will serve the Government of Haryana for the period of minimum period of 7 years for PG Degree/Super Specialty and for a minimum period of 5 years in case of PG Diploma Course.

D. Consequences of failure to complete the course of study within the prescribed period or leaving the same midway.

i) In case the sponsored candidate fails to complete the course of study within the prescribed period, he shall be allowed to avail a maximum of three more chances to complete the same. The period taken in completion of course beyond the prescribed period may be allowed as EOL, without pay but the extended period of EOL will not be counted as service for any purposes e.g. increments grant of Higher Standard Scales linked with service period, pension etc.

ii) “In case the employee concerned leaves the course of study midway without completing the same to the decision of the constitution for reasons, whatsoever he will be liable to refund the amount he would have received on account of study leave to the Government and the period from the date of relieve viz from the government service till the date of joining shall be treated as period of extra ordinary leave without pay unless he has been incapacitated on medical grounds and the head of institution certifies the fact of incapacitation and recommends the exemption of the above. Further, this period of EOL shall not be counted as service for any purpose e.g. pension, etc. the employee concerned will also be debarred of five years for NOC for Higher studies.”

E. Permission to pursue course of Higher studies against open seats.

1. A certain number of in service candidates in HCMS/HMES may like to seek admission to PG Diploma courses/PG Degree Courses/Super Specialty courses against open competition seats in various institutions. The Government would consider issuing NOC to such candidates subject to fulfillment of following conditions.

i. The candidate must have completed his probation period and has completed satisfactory service of minimum period of three years including probation period. In case of a candidate belonging to HCMS should be rendered two years service in the rural areas out of a total three years services. However, the conditions of rural service will not be applicable in the case of member of HMES.

ii. There should be nothing adverse against his integrity and efficiency.

iii. His service can be spared by the employer for the duration of the course without adversely effecting larger public interest.

iv. In addition to the above if a Doctor has already studied for PG Diploma course in any subject under the Government Scheme as in service candidate, he will be considered for grant of No Objection Certificate” only for the PG Degree Course in that very discipline/subject provided he has completed the period of bond/bank guarantee executed by him while proceedings for the diploma course.

v. The in-services candidates, who already have a PG Degree to their credit in any subject and want to do a diploma course in the same subject on in any other subject will not be considered for issuance of NOC.

vi. A Doctor, who has completed PG Diploma course in any subject and wants to go in for PG Degree course in a subject other than the one in which he had done the diploma, will not be considered for “No Objection Certificate”.

vii. A Doctor, who has a PG Degree to his credit, will be considered for super in the same stream.


2. After the NOC is issued to the applicant, his admission will be governed by the admission rules of the institution/University.


3. Once a candidate who has been granted NOC for admission on Higher Study against the open seats, succeeds in getting admission to the said course, he will be required to take the following steps.


i) He will have to apply for the leave of kind dye under the rules under the rules for the duration of the course of study the leave period will be considered for the duration of the course as prescribed by the competent authority.

ii) Consequent upon sanction of leave and before his relieving from the Department he will have to submit a bank guarantee of Rs. 7 lacs in the case of Degree Course and Rs. 5 lacs in case of Diploma Course. He will serve the Government of Haryana for the period of minimum period of 7 years for PG Degree/Super Specialty and for a minimum period of 5 years in case of PG Diploma Course.

F. Consequences of failure to complete the course of study within the prescribed period or leaving the same mid-way.

i) In case the services candidate fails to complete the course of study within the prescribed period, he shall be allowed to avail a maximum of three more chances to complete the same. The period taken in completion of course beyond the prescribed period may be allowed as EOL will not be counted as service for any purpose e.g. increments, grant of Higher Standard scales 1 linked with service period, pension etc. ii) “In case the employee concerned leaves the course of study mid way without completing the same to the satisfaction of the institution for reasons, whatsoever he will be liable to refund the amount he would have received on a account of study leave to the Government and the period from the date of relieve viz form the Government service till the date of joining shall be treated as period from the date of relieve viz form the Government service till the date of joining shall be treated as period of extra ordinary leave without pay unless he has been incapacitation on medical grounds and the medical institution certificates the fact of incapacitation and recommend the exemption of the above. Further, this period of EOL shall not count as service for any purpose e.q. position etc. The employee concerned will also be debarred for a period of five years for NOC for Higher Studies”.


Stipend/Fellowship:-


1. Candidates sponsored against reserved seats.
Stipend is paid to PG Diploma/Degree course students in the PGIMS Rohtak. The candidates admitted to PG Diploma /Degree courses against eh receive any amount on account of stipend so long as they are on half pay study leave. However, the in-service candidate will be entitled to received the stipend at the rates in force time to time for the period of EOL, without pay during the course of study. Further, the candidates under this category will have the option to either receive the full pay/half pay as admissible under the case of stipend admissible is more beneficial to them, they may avail EOL instead of study leave for the duration of the course of study. Option once exercised will not be allowed to be changed.

2. Candidates admitted to Higher Courses of Study against open seats:-
The admissibility of half pay in lieu of study leave on the stipend in case of in-service candidates admitted to PGIMS Rohtak in this category will be the same as provided above in the case of candidates admitted against reserved seats. The candidates admitted against reserved seats. The candidates admitted to PG Diploma/Degree/Super Specialty course against the open seats in institution other than PGIMS Rohtak and under going the same by availing of leave of kind due including study leave, will be entitled to receive the stipend/fellowship amount that may be payable by the institution during the course period in addition to the emoluments he may be entitled to receive on account of study leave.


H. Treatment of unutilized reserved seats.
Seats reserved in the PGIMS Rohtak for the HCMS Doctors in various PG Diploma/Degree courses to the extent the same remain unutilized from among the HCMS may be available for the open candidates on year to year basis.

This policy is subject to the amendment in the CSR Volume 1 Part II (Appendix – 20)

The above policy may be brought in the of all concerned.
