2. Request for clarification has been received from some quarters about the State Govt. Instructions issued vide letter No. 18/94/96-IHBI dated 20.12.1996 amending certain provisions of the earlier policy. Notwithstanding anything contained earlier instructions in this regard the following criteria shall be apply for seeking NOCs/sponsorship for different courses.

3. It is clarified that only these doctors should be considered eligible for giving No Objection Certificate for doing MS/MD/diploma courses, who fulfill the following conditions.

Reserved Seats (MD/MS/Diploma)

a) Has been appointed on regular basis, has completed the probation period and has been completed the 5 years, but out of which, 3 years services should be in Rural area and he should have nothing adverse in this regard to his efficiency and integrity.

Period spent on ad hoc basis in the State followed by Regularization and services in Rural area of the State will be counted towards the service of 5 years and 3 years from Rural Service.

While calculating the 5 years and 3 years service, period spent on probation shall be counted, but any period on extra ordinary leave, leave without pay etc. will not be counted.
b) The doctor while doing the course will be treated on duty and will be paid full pay and allowance for the duration of the course.

II. OPEN SEATS
Had been appointed regulars basis, has completed probation period, there is nothing adverse regarding efficiency and integrity and has 5 years service in the State out of which he should have completed 3 years in Rural service in the State.

The period spent on the ad hoc service in the State and in the Rural Area in the State will be taken in to account for the purpose of counting the period of 5 years and 3 years rural services respectively.

While calculating the above said period of 5 years and 3 years the period spent on probation shall be counted, but any period spent on extra ordinary leave or leave without pay etc. will not be counted.
He will be granted extra ordinary leave for the duration of the M.S. Diploma Courses if he receives stipend/sponsorship from the concerned institute, however, if he does not received any stipend/scholarship from the concerned institute, he will be allowed save of the kind due.

3. All other HCMS Doctors, who are not covered under the above categories will be issued No Objection Certificate for doing MD/MS/Diploma Courses in Pandit B.D. Sharma PGI Medical Science, Rohtak and other medical Institute of the country on the condition that they have to resign from service in case they are selected for the courses.

4. In addition to the above if a doctor has already done diploma course in any subject, he will be considerable for grant of No Objection Certificate against the reserve and open seat provided the fulfilled the above mentioned criteria and the period of bond executed by him while doing diploma has been completed. The doctors who have already done MD/MS/Diploma courses in any subject and want to do diploma courses in the same subject or any other subject will not be considered. A doctor who has done diploma in any of subject other than in which he has done the diploma, will not be considered for No Objection Certificate.

5. After the issue of the “No Objection Certificate” against reserve seats, the doctor will have to appear in the common entrance test to be conducted by the Competent Authority notified by the Govt. and will have to obtain atleast 20% marks. The last date of the receipt of the application will be cut of date of the calculating service.
6. The selection committee for admission against the reserve seats for HCMs doctors in MD/MS/Diploma courses in Pandit Bhagwat Dayal Sharma PGI of Medical Science, Rohtak will comprise of the following members:
1. Commissioner & Secretary

2. Director General, Health Service
Haryana, Member

3. Pt. B.D. Sharma, P.G.I. of Medical
Science Member

4. Director, Health Services, Haryana Member


7. Super Speciality Courses
A Doctor will be considered eligible for consideration for giving a No Objection Certificate/sponsorship Certificate (Reserve Seat) for superspeciality Courses (D.M. etc) iF he has rendered 5 years of service with the Haryana Govt. after doing his post graduation course, during the period of course, he will be treated on deputation and paid full emoluments for open seats, he will be allowed extra ordinary leave, he will also execute a bond to serve the state for 5 years or to pay Rs. 10 lacs in Govt. Treasury.

Note: This criteria will also be applicable to the doctors of Pt. B.D.S, PGIMS, Rohtak.
In this case 5 years service will be counted as service in Pt. B.D.S, PGIMS, Rohtak provisions of rural service will not be insisted on.

8. The course period for MD/MS/DM will be only two years beyond which the person will not be considered on duty.

9. No change of subject will be permitted during the course.

10. A doctor in the State (For health as well as Medical Education Department) before being relieved for any post graduation super speciality course will execute a bond for serving the State (in HCMS Cadre) for 5 years on to pay Rs. 10 lacs in Govt. Treasury in lieu thereof. Before being relieved for any diploma course, he will have to execute a bond to serve the State (in HCMS Cadre) for 5 years or to pay Rs. 3 lacs in Govt. Treasury in lieu thereof.

11. It is also in emphasis that grant of NOC/sponsorship certificate is not a matter of right. The Govt. shall see the feasibility of each and every case on merit after a particular employee fulfills the eligibility criteria given before taking a decision in public increase and administrative constrain.

Subject: In service training HCMS Doctors for MS/HS/Degree and Diploma Courses in Pandit B.D. Sharma, P.G.I. of Medical Sciences Rohtak against reserved and open seats

References your Letter No. 13/39-2E11-95/2005 dated 20.2.95 on the subject noted above.

2. In partial modification of existing policy issued vide memo No. 18/83/89-IHBI, dated 11.3.1994 for the grant of No Objection Certificate to HCMC doctors for doing P.G. Course (MD/MS and Diploma), the State Government has decided to revised the existing policy as under:-

Reserved Seats (MD/MS) Diploma Courses:-

a) HCMs Doctors who are appointed on regular basis and there is nothing adverse regarding their efficiency or integrity and have total service of 2 years in the State including one year of rural service in the State will be eligible for the grant of No objection certificate for doing P.G. Course against reserved seats in Pandit B.D. Sharma, P.G.I. of Medical Science Rohtak.

b) The period spent on ad hoc service in the State and in the rural areas in the State will be taken in to account for the purpose of counting the period of two years service in the State and one year rural services respectively.

c) In lieu of doing the P.G. Course they will have to execute a bond to serve the State Govt. for a period of ten years and in the case, they fail to serve the State Govt. they will have to deposit in Govt. Treasury Rs. 5,00,000/- for PG (MD/MS) and Rs. 3,00,000/- for Diploma Courses on demand by the State Govt. HCMS Doctors selected against reserved seats will be treated on duty and they will be paid fully paid and allowances for the duration of their course.
Open Seats:
a) HCMS Doctors who have successfully completed the protection period and there is nothing adverse regarding their efficiency or integrity but are in eligible for admission against reserved seats will be granted No Objection certificate for doing PG Courses (MD/MS) and Diploma in Pandit B.D. Sharma PGI of Medical Science, Rohtak and other Institutions in the country.
b) They will be granted extra-ordinary leave for the duration of the MD/MS Diploma courses and they will receive stipend from the Institution. However, if they are not getting and stipened/scholarships from the Institutions, they will be allowed leave of kind due.
c) In lieu of doing the PG/Diploma Courses, they will execute a Bond to serve the State Govt. for a period of five years in the case of MD/MS Courses, for 3 years in the case of Diploma. In case, they fail to serve the State Govt. they will deposit in Govt. Treasury Rs. 40,000/- and Rs. 20,000/- respectively.

2. All such other HCMS doctors who are not covered under the categories mentioned in para I above will be issued No objection certificates for doing MD/MS Diploma Courses to Pandit B.D. Sharma P.G.I of Medical Science Rohtak and other Medical Institution in the country, on the condition that they have to resign from service in the case they are selected for the PG/Diploma Course.

3. In addition to the above conditions the HCMS doctors who have already done Diploma Courses in any subject in any subject and if any want to do MD/MS degree course in the same subject they will be considered for grant of No Objection Certificate against the reserved/open seats, provided they fulfill the above mentioned conditions and the period of bond executed by them while doing diploma has been completed provided further that such doctors who have already done MD/MS degree courses in any subject and if they went to do diploma courses in the same subject or any other subject and they will not be granted No Objection Certificate. Provided further that such doctors who have done diploma in any subject and if they want to do MD/MS/Diploma Courses in Pandit B.D. Sharma P.G.I. of Medical Science, Rohtak will comprise of the following members:

(Senior Scale) Member

The criteria prescribed for granting admission against the reserved seats in Pandit B.D. Sharma, PGI of Medical Sciences, Rohtak is enclosed at Annexure-A. Interview will be held at Chadigarh.
The issues with the concurrence of Finance Department conveyed vide their H.O. No. 10/20/94-3 FR-II/104 Dt. 1.2.1996.
