Policy to Regulate Transfer of HCMS Doctors (Click the circular to enlarge)


POLICY TO REGULATE TRANSFERS OF DOCTOR (HEALTH DEPARTMENT)

The issue of laying down a rational transfer policy in respect of HCMS Doctors in Haryana State has been gaining the attention Of the State Government. A meeting was held under the Chairpersonship of DHS (Trg.) and the issue was considered keeping in view providing better health services to the people of Haryana especially rural and far flung remote area. As per National Rural Health Mission all CHCs are to be upgraded as FRU in phased manner, these FRUS should have one Physician, Surgeon, Pediatrician, Anesthesia and Gynae & Obst as per IPHS norms. There are -51 Hospitals, 83 CHCs and 420 PHCs in Health Department, Haryana where the irrational placement of doctors including specialists is a constant concern for the State. Hence there is a need to form a new transfer policy of HCMS cadre.
Under NRHM, adequate funds are available for infrastructure development and necessary equipments as per I PHS norms and a lot of infrastructure has been already developed so as to improve the availability of quality specialists and emergency health care to the people especially in the rural area. The transfer policy of the department was issued by the Govt. No. 2.5/4/2006-6HB-I, dated 21.09.2005. However, following suggestions are made by the committee.
The transfers of doctor in Haryana shall be regulated strictly in accordance with the following guidelines.
1. Normal tenure of a doctor/specialist at any place of posting shall be a minimum of 3 years. Furthermore a doctor shall not be transferred even after 3 years in case his work (measured in terms of OPD/IPD/National Programmes) has been found to be satisfactory and he wishes to continue in that health institution.
2. A doctor can be transferred at any point of time after seeking prior orders of the State Government on administrative grounds. However, specific administrative ground on which a doctor is sought to be transferred shall be cited in the noting of the file. Usually, an administrative ground for transfer to a doctor shall be of the nature as given below:-
(a) A complaint established through a preliminary enquiry. The specific complaint received through MPs/MLAs/Chairman M.C./Sarpanch Gram Panchayat would be enquired into by the Civil Surgeon and the report shall be sent to the Directorate within 10 days of the receipt of such complaint for further action.
(b) Failure to comply with the directions issued by the Directorate regarding maintenance of record relating to all health activities or other important instructions issued from time to time.
(c) Poor performance i.e. poor OPD, IPD, contribution in National programmes.
(d) Failure to comply with the specific direction issued by the Govt./Directorate regarding Health Services, prescription & deficiency of drugs etc.
(e) Prima facie case of indulging in private practice of other unethical activities.
3. Request of doctors for transfer to their preferred stations shall only be entertained on following grounds:
a) The request shall be made to the DGHS through CS only up to 10th Aprii. DGHS shall make their recommendations up to 30th April to the Government. The transfer orders shall be made up to 30th May.
b) The request shall be made only in the prescribed format. It would be mandatory to indicate three choices. Any application with less than three choices will be rejected straight way.
c) If a doctor makes a request to the C.M. /H.M. and other elected representatives, he shall also send his request on the enclosed prescribed format (Annexure "A". The department will try to accommodate the doctor against available vacancy from amongst his options.
d) In case of clash of choice of more than one doctor for a particular health facility, merit in case of new appointments and OPD/IPD data of last three years, in case of old doctors would be the guiding criteria for allotment of health institution.
e) If no vacancy becomes available as per the policy in the three requested health institutions, the transfer will not be done till a vacancy becomes available, for which the applicant would have the first right.
4. On first appointment and ion case of promotion, the doctors shall give three choices of vacant rural health institutions and the department will try to accommodate them in order of merit/seniority. However, they will have to serve at the allocate station for at least 3 years. For this purpose, they will have to submit an undertaking a1ongwith the request that they wi11 not make any request for transfer if they are accommodated in one of the three preferred stations.
5. The District Hospitals would 'have one doctor each with specialization in 12 disciplines e.g. Medicine, Surgery, Pediatrics, Gynae, Anesthesia, Ortho, Eye, ENT, Skin, Psychiatry, Pathology and Radiology. Biochemistry & Microbiology specialists would also be utilized in district Hospitals. Posts of additional specialists would be provided only if patient load exceeds the stipulated limit. The load in this regard would be defined by the Department unambiguously.
6. A doctor with Postgraduate qualifications would not be posted in PHC, CHCs declared as FRUs would get specialties in the 1st phase. In case of transfer of a specialist doctor with the same specialty would be posted as a replacement. Those who have received EMOc/CMOc training would also be posted in a CHC designated as First Referral Unit.
7. In PHCs, CHCs and sub Divisional Hospital, Specialists and MBBS doctors would be posted strictly in accordance with staffing norms only. A single doctor in each sanctioned specialiaty would be provided. Similarly in district hospitals, specialist and MBBS doctors would be provided as per staffing norms. Doctor would not be posted in excess of sanctioned posts.
8. Vacancies created due to promotion/retirement/ death etc. would firstly be filled from amongst doctors, who have given the choice of that particular institution in the prescribed performa at the time when they are asked to submit their requests. If no such regular doctor is available then the post may filled up on contract for one year.
9. Those who are retiring in next one year will not be transferred except on their own request, subject to vacancy/mutual consent.
10. If the husband and wife both are in the service of the Haryana State Government, efforts will be made to adjust them as near as possible. Preference would be given to those both of whom are serving in the Health Department.
11. Specialists would not be posted on non-Clinical posts up to district level.
12. Doctors whose performance is found to be poor in respect of OPD, IPD, National Programmes or who are prima-facie guilty of malpractices such as charging of personal fee from patients, private practice, pilferage of sale of Govt. medicines, prescriptions to favour certain specific brands, indiscriminate prescription of diagnostics test which are not available in Govt. Health facility would be transferred on administrative grounds.
13. Against vacancies as on" 1st June, contractual appointments of doctors would be made as per policy of the State Govt. Any transfer orders approved by the State Govt. after 1st June would be implemented only in April next year so that contractual arrangements are not discontinued midyear and health care to patients is not disrupted.
14. Vacancies created due to promotion/retirement/death etc. would first be filled from amongst doctors who have given choice of that particular health facility in the prescribe performa at a time when they were supposed to submit their requested i.e. 10th April.
15. No TA/OA will be given if the transfer is done at the request of the doctor himself or if he is being given the posting of his own choice.
16. Transfer orders would be implemented within one week of issue. DDOs would ensure relieving/joining of respective doctors within stipulated time. No salary can be drawn in case noncompliance of transfer orders after stipulated period of one week. DDO will be personally held responsible for any neglect in this regard.
17. Civil surgeon shall submit consolidated report of relieving/joining of doctors arid engagement of contractual specialist to update the computer data within a fortnight.
18. Transfer of Civil Surgeon will not be covered under this policy.

No Time for HCMSA Central Executives to conduct the meeting and sharing of facts with Distt Executives?

I think Our Central Executive are very busy now a days that they don't have any time to conduct meeting of the Executive Committee and even they postponed the already fixed date which was earlier decided by the house. Meeting was rescheduled and later cancelled, I feel that our central executive has to first ask the administration for the date of the meeting and if they give any date in the year 2010, it will be suitable for them???????????????????
Please opine on this issue and give ur comments.....

Subject: Application to treat at par the salary policy of Dr Anil Kumar Dhull doing MD
Course in Radiotherapy in the light of provisions of the revised policy of Govt. of
Haryana Dated, the Chandigarh 10-03-2008

Respected Madam,
Please accept kudos on the implementation of the highly commendable and visionary revised policy vides Government of Haryana Memo No. 2/123/05/1HB-I Dated, the Chandigarh 10-03-2008, the relevant provisions of the same extracted herein below for your ready reference:

A (1): HCMS doctors serving in connection with the affairs of the State Government in the Health Department and those serving in the PGIMS Rohtak may be allowed to apply for and seek admission in various academic courses leading to PG Degree Courses in their respective streams of Medical profession and the entire period of the higher study (PG Degree) will be treated as on duty with full pay and allowances.

G (1): The entire period of the higher study will be treated as on duty with full and allowances to candidates admitted to PG Degree courses against the reserved seats.

H: This policy will also be applicable to those who are doing PG Degree courses.

In the light of above said laudable policy prepositions and particular facts as stated below I wish to state most respectfully that;
1. That I, Dr Anil Kumar Dhull, HCMS-II doing my higher studies (MD Course) under HCMS reserve seat in the Department of Radiotherapy w.e.f 10-05-2006 forenoons as per the policy constituted by Government of Haryana vide Memo No. 2/123/05 1HBI dated, the Chandigarh 24.2.2006 in year 2006 which was later substituted by the Government Memo No. 18/94/96-1HB-1, Dated, the Chandigarh 26.04.2002 and was enforced as the preexisting policy which is now again revised by Government of Haryana vide Memo No. 2/123/05/1HB-I Dated, the Chandigarh 10-03-2008 and said to be the existing policy regarding higher studies for doctors under HCMS reserved PG courses.
2. That my bond for the above said PG course in Radiotherapy has been accepted vide Commissioner & Secy to Government Haryana letter Memo No. 2/261/07/1HB-I Dated, the Chandigarh 24-12-2007.
3. That till date I have not received any salary or stipend from PGIMS Rohtak.
4. That I get to know that Dr Sachit Sharma, Medical Officer on Higher Studies in Department of Urology in AIIMS, who is doing higher studies course from AIIMS New Delhi has been granted with full pay and allowances along with the period of course to be treated as on duty. This particular instance of favoritism and sheer arbitrariness on behalf of concerned authorities is excruciatingly annoying me and putting undue mental agony and stress tantamount to official maltreatment. It is agonizingly stated that such selective issuance or waiver of necessary conditions is a pathetic aberration amounting to willful distortion of avowed equality clause as enshrined in the constitutional law of India which is needless to say is the paramount and absolute law of the land. I have no personal grudge or enimity against my fellow who is attracting favour from the Govt. but the manner and method in which government bounty is being dole out is of utmost concern to me which is staring at my face with contempt and abusing my sense of worthiness and self esteem, after all I too have given my most productive and energetic professional years in the august service to the state not the private purse, I have not run after the American dream of instant enrichment. I know that same is supposed and expected from me being an Indian citizen and article 51 A of the Indian constitution mandate the same as fundamental duty of mine, yet what offends me is the raw deal by administrative fiat, I wish to comment that to treat equals unequally amounts to violation of equality, and arbitrariness is antithesis to rule of law. I wish to state ardently and request agonizingly that mine case should be treated at par and sympathetically keeping in view the human aspect as well as legal aspects thereof.
5. That now when the new policy vide Memo No. 2/123/05/1HB-I Dated, the Chandigarh 10-03-2008, is in existence and applicable to all the doctors who are doing the PG course, it is requested that henceforth the same should be applied in my case also as per clause A (1) of this stated policy and I may be allowed to provide the full pay and allowances along with the period of course to be treated as on duty or otherwise your good self is requested to kindly treat my case at par with my fellow friend as discussed above in great deal.
6. That it is humbly requested to your kind office to reconsider my case keeping in view of the aforesaid facts and I may be granted to get the full pay and allowances along with the complete period of course to be treated as on duty which is according to the provision of the new policy dated 10-03-2008 also.
In view of the aforesaid facts and circumstances mentioned, it is humbly reiterated that this issue should be treated as urgent and necessary administrative action should be taken in this regard lest I will be forced to resort to legal remedy which is the last bastion for aggrieved ones, whose liability will be of your good office.
It is my anxious request that keeping in view of my grievances, this matter to be considered on priority and I know that Government process always takes some time but I consider that one month is sufficient time to decide and incorporate the relevant things in the administrative orders. I am of the considered view that as prayed aforesaid the interests of medical fraternity in particular and public interest at large will be duly kept in view while taking the appropriate policy decisions and I may be granted with the full pay and allowances along with the complete period of course to be treated as on duty.

Higher Studies Policy 2008

Subject: Policy Regarding Higher Studies for Doctors in the Department of health and Medical Education and PGIMS, Rohtak.

Kindly refer to Government Memo No. 18/94/96-1HBI dated 26.04.2002 on the subject noted above.
The matter has been reconsidered by the Government keeping in view the shortage of Specialist Doctors in various streams in the Department, it is feIt that the existing policy be revised to encourage MBBS doctors to take up post graduation degrees, Accordingly the policy cited as subject have been modified under:-
A General
1. HCMS/HMES doctors serving in connection with the affairs of the State Government in the Health Department and those serving in the PGIMS Rohtak may be allowed to apply for and seek admission in various academic courses leading to PG Diploma/ Degree/Super specialty Courses in their respective streams of Medical profession and the entire period of the higher study (PG Diploma/ Degree/Super specialty Courses) will be treated as on duty with full pay and allowances.
2. Permission to go in for Higher Studies to the in service candidates is not a matter of Right. It will be subject to specific approval by the government which will depend upon various factors i.e. possibility to spare one’s services without adversely affecting the larger public interest, the felt needs for specialists in various discipline on the basis of a review carried out from time to time and other exigencies of service.
3. The basic condition for eligibility is three years regular service with successful Completion of probation period out of which two years service is essential in rural areas for both for reserved and open seats in the case of HCMS doctors. However, the condition of rural service will not applicable in the case of a member of the HMES.
4. The requisite length of service shall be calculated as to the last date of submission of application for the relevant courses (s).
5. The upper age limit for PG Diploma/ Degree/Super specialty Courses will be 40 years.
6. The period of higher studies, as admissible under the rules, shall count as service for all-purpose subject to the condition of successful completion of the course of study within the prescribed period.
B Procedure:
The procedure for availing of the opportunity of Higher studies under the policy would be as under:1. In the first instance, the Doctor concerned shall have to apply for “No objection certificate” (NOC) form his employer for submitting/forwarding his application to the institution concerned for admission to the course of study.
2. Once the NOC is issued by the employer, the process of admission will be regulated in accordance with the admission rules of the institution/university concerned.
3. After the candidate receives intimation regarding his admission to the said approved course of study, he shall submit an application for his relieving. The competent authority will relieve him after completion of formalities including execution of bond as required under rules/instructions. The candidate will be allowed to join the institution on production of proper relieving order after being relieved by the competent authority and the completion of formalities of execution of Bond as required under rules/instructions are fulfilled.

C. Sponsorship of the candidates for Higher Studies against reserved seats.

Presently, certain number of seats are reserved in the PGIMS Rohtak for PG Diploma/PG Decree courses for the in service employees of HCMS. The cases of in services candidates for higher studies against reserved seats will be regulated as follows:

1. Candidates keen to go in for Higher Studies for the PG Diploma/PG Degree courses against the reserved seats will be required to apply for a “No Objection Certificate” to the Competent authority before submitting their application for admission to the said courses. Only those candidates will be considered for NOC under this category who fulfill the following conditions.
i) He/She must have completed the probation period successfully and completed three years service under the State Government including the probation period out of which two years service should be in rural areas. However, the condition of rural service will not applicable in the case of a member of the HMES.
ii) There should be nothing adverse against his integrity and efficiency.iii) His service can be spared by the employer for the duration of course without adversely affecting the larger public interest.iv) In addition to the above, if a Doctor has already studied for a PG Diploma course in any subject under the government Scheme as an in service candidates, he will be considered for grant of “No Objection Certificate” only for the PG Degree course in that very discipline subject provided he/she will not be entitled to claim this facility under this policy unless they have completed the previous service Bond.v) The in-service candidate, who already has PG Degree to their credit in any subject and want to do a diploma course in the same subject or in any other subject, will not be considered for issuance of NOC.vi) A Doctor who has completed a PG Diploma course in any subject and wants to go in for PG Degree course in a subject other than the one in which he has done the diploma, will not be considered for “No Objection Certificate”.
2. After the NOC is issued to the applicant, his admission will be governed by the rules of institution/university. However, the candidate will have to appeal in the entrance test conducted for admission to the relevant course and obtain minimum 50% marks in order to be eligible for admission to the course.
3. Before his relieving from the department he/she will have to execute a service bond for a minimum period of 7 years or pay an amount of Rs 10 lack to the Haryana Government in lieu thereof in the case of PG Degree /Super Specialty courses and for a minimum period of 5 years in case of PG Diploma.
D. Consequences of failure to complete the course of study within the prescribed period or leaving the same midway.

i) Consequences of failure to complete the course of Study within the prescribed period or leaving the same midway they will refund the amount received on account of duty for study and the period from the date of relieving to the date of joining back will be treated as period of EOL without pay unless he has been incapacitated on medical ground and medical institution certifies the facts of, incapacitation and recommend exemption of the above. This period of EOL shall not count as a service for any purpose and employee will be debarred for a period of 5 years for NOC for higher studies.
ii) If they get any stipend/remuneration from any institute will be deposited in Haryana Govt. Treasury.

E. Permission to pursue Course of Higher studies against Open Seats:
1. A certain number of in service candidates in HCMS/HMES may like to seek admission to PG Diploma courses/PG Degree Courses/Super Specialty courses against open competition seats in various institutions. The Government would consider issuing NOC to such candidates subject to fulfillment of following conditions.
i) The candidate must have completed his probation period successfully and completed a minimum period of 3 years regular service including the probation period. In the case of a candidate belonging to HCMS, he should have rendered two years service in the rural areas out of a total of 3 years service. However, the condition of rural service will not be applicable in the case of member of the HMES.
ii) There should be nothing adverse against his integrity and efficiency.
iii) His services can be spared by the employer for the duration of the course without adversely affecting the larger public interests.
iv. In addition to the above if a Doctor has already studied for PG Diploma course in any subject under the Government Scheme as in service candidate, he will be considered for grant of No Objection Certificate” only for the PG Degree Course in that very discipline/subject provided he has completed the period of bond executed by him while proceedings for the diploma course.
v. The in-services candidates, who already have a PG Degree to their credit in any subject and want to do a diploma course in the same subject or in any other subject, will not be considered for issuance of NOC.vi. A Doctor, who has completed PG Diploma course in any subject and wants to go in for PG Degree course in a subject other than the one in which he had done the diploma, will not be considered for “No Objection Certificate”.vii. A Doctor, who has a PG Degree to his credit, will be considered for super in the same stream.
2. After the NOC is issued to the applicant, his admission will be governed by the admission rules of the institution/University.

F. Consequences of failure to complete the course of study within the prescribed period or leaving the same mid-way.

i) In case the services candidate fails to complete the course of study within the prescribed period, he shall be allowed to avail a maximum of three more chances to complete the same. The period taken in completion of course beyond the prescribed period may be allowed as EOL without pay but this extended period of EOL will not be count as service for any purpose e.g. increments, grant of Higher Standard scales linked with service period, pension etc.
ii) In case the employee concerned leaves the course of study mid way without completing the same to the satisfaction of the institution for reasons, whatsoever he will be liable to refund the amount to the Government he would have received as pay and the period from the date of relief from the Government service till the date of joining shall be treated as period of extra ordinary leave without pay. Further, this period of EOL shall not count as service for any purpose e.g. increments, grant of higher standard scales linked with service period, pension etc. The employee concerned will also be debarred for a period of five years for NOC for Higher Studies”.

G. Stipend/Fellowship:
1. Candidates sponsored against reserved seats:
The entire period of the higher study will be treated as on duty with full and allowances to candidates admitted to PG Diploma/Degree/Super Specialty course against the reserved seats. If they get any stipend/remuneration from any institute will be deposited in Haryana Govt. Treasury.

H. Treatment of unutilized reserved seats:
Seats reserved in the PGIMS Rohtak for the HCMS Doctors in various PG Diploma/Degree courses to the extent the same remain unutilized from among the HCMS may be available for the open candidates on year to year basis.

This policy will come into force from the date of issue. However, this policy will also be applicable to those who are already doing PG Diploma/ PG Degree/ Super Specialty courses for the remaining period of course.
The above policy may be brought to the notice of all concerned.

Higher Studies Policy 2006

Subject: Policy Regarding Higher Studies for Doctors in the Department of health and Medical Education and PGIMS, Rohtak.

Kindly refer to Government Memo No. 18/94/96-1HBI dated 26.04.2002 on the subject noted above.

The matter has been reconsidered by the government. Keeping in view the shortage of Specialist doctors in various streams in the Department, it is felt that the existing policy be revised. Accordingly the policy cited as subject have been modified as under.


A. General

1. HCMS/HMES Doctors serving to connection with the affairs of the State Government in the Health Department or those serving in the PGIMS Rohtak may be allowed to apply for seeking admission in various academic course leading to PG diploma/PG Decree/Super Specially courses in their respective streams of Medical Profession for which they will have to apply for and avail study leave under the relevant rules.

2. Permission to go in for Higher Studies to the in service candidates is not a matter of Right. It will be subject to specific approval by the government which will depend upon various factors i.e. possibility to spare one’s services without adversely affecting the larger public interest, the felt needs for specialists in various discipline on the basis of a review carried out from time to time and other exigencies of service.

3. The study leave in the first year will be granted on full pay (without allowances) and for the second year only hall pay (without allowances) will be allowed.

4. The adhoc service followed by regular service and counted for the purpose of increment shall be taken into account while calculating the requisite length of service.

5. A candidate keen to go for Higher studies but who does not fulfill the prescribed length of service as required for study leave will have to resign for the purpose of pursuing Higher Studies.

6. Study leave shall not ordinarily be granted in case of an employee who is due to retire or has the option to retire from govt. service within five years of the date on which he is expected to return to his duty after completion of his course.

7. The requisite length of service shall be calculated as to the last date of submission of application for the relevant courses (s).

8. The period of study leave kind due for the purpose of higher studies as admissible under the rules, shall court as service for all purposes subject to condition of successful completion of the course of study within the prescribed period. The period of EOL taken for the purposes of Higher Studies may also be allowed to count towards service for the purposes of increments and pension and is at the discretion of the competent authority.


B. Procedure :

The procedure for availing of the opportunity of Higher studies under the policy would be as under :


1. In the first instance, the Doctor concerned shall have to apply for “No objection certificate” (NOC) form his employer for submitting/forwarding his application to the institution concerned for admission to the course of study.

2. Once the NOC is issued by the employer, the process of admission will be regulated in accordance with the admission rules of the institution/university concerned.

3. After the candidate receives intimation regarding his admission to the said approved course of study, he shall submit an application for grant of sanction of leave as per entitlement. The said candidate will be allowed to relieve from his duties so as to enable him to join the course of study only after the leave is sanctioned by the competent authority and the formalities of bank guarantee as required under rules/instruction are fulfilled.

C. Sponsorship of the candidates for Higher Studies against reserved seats.


Presently, certain number of seats are reserved in the PGIMS Rohtak for PG Diploma/PG Decree courses for the in service employees of HCMS. The cases of in services candidates for Higher studies against reserved seats will be regulated as follows:


1. Candidates keen to go in for Higher Studies for the PG Diploma/PG Degree courses against the reserved seats will be required to apply for a “No Objection Certificate” to the Competent authority before submitting their application for admission to the said courses. Only those candidates will be considered for NOC under this category who fulfill the following conditions.

i) He/She must have completed the probation period successfully and completed three years service under the State Government including the probation period out of which two years service should be in rural areas.

ii) There should be nothing adverse against his integrity and efficiency.

iii) His service can be spared by the employer for the duration of course without adversely affecting the larger public interest.

iv) In addition to the above, if a Doctor has already studied for a PG Diploma course in any subject under the government Scheme as an in service candidates, he will be considered for grant of “No Objection Certificate” only for the PG Degree course in that very discipline subject provided he has completed the period of bank guarantee/bond period while proceeding for diploma course.


v) The in-service candidate, who already has PG Degree to their credit in any subject and want to do a diploma course in the same subject or in any other subject, will not be considered for issuance of NOC.

vi) A Doctor who has completed a PG Diploma course in any subject and wants to go in for PG Degree course in a subject other than the one in which he has done the diploma, will not be considered for “No Objection Certificate”.

2. After the NOC is issued to the applicant, his admission will be governed by the rules of institution/university. However, the candidate will have to appeal in the entrance test conducted for admission to the relevant course and obtain minimum 50% marks in order to be eligible for admission to the course.

3. Once the candidate sponsored against the reserved seats and succeeds in getting admission to the said course, he will required to take the following steps.

(i) he will have to apply for the study leave/leave of kind due for duration the course of study. The leave period will be considered for the duration of the course by the competent authority.

(ii) Consequent upon sanctioning of leave and before his relieving from the department, he/she will have to submit a bank guarantee of 7 lacs in case of case of Degree course /Super Specialty course and Rs. 5 lacs in case of Diploma Course. He will serve the Government of Haryana for the period of minimum period of 7 years for PG Degree/Super Specialty and for a minimum period of 5 years in case of PG Diploma Course.

D. Consequences of failure to complete the course of study within the prescribed period or leaving the same midway.

i) In case the sponsored candidate fails to complete the course of study within the prescribed period, he shall be allowed to avail a maximum of three more chances to complete the same. The period taken in completion of course beyond the prescribed period may be allowed as EOL, without pay but the extended period of EOL will not be counted as service for any purposes e.g. increments grant of Higher Standard Scales linked with service period, pension etc.

ii) “In case the employee concerned leaves the course of study midway without completing the same to the decision of the constitution for reasons, whatsoever he will be liable to refund the amount he would have received on account of study leave to the Government and the period from the date of relieve viz from the government service till the date of joining shall be treated as period of extra ordinary leave without pay unless he has been incapacitated on medical grounds and the head of institution certifies the fact of incapacitation and recommends the exemption of the above. Further, this period of EOL shall not be counted as service for any purpose e.g. pension, etc. the employee concerned will also be debarred of five years for NOC for Higher studies.”

E. Permission to pursue course of Higher studies against open seats.

1. A certain number of in service candidates in HCMS/HMES may like to seek admission to PG Diploma courses/PG Degree Courses/Super Specialty courses against open competition seats in various institutions. The Government would consider issuing NOC to such candidates subject to fulfillment of following conditions.

i. The candidate must have completed his probation period and has completed satisfactory service of minimum period of three years including probation period. In case of a candidate belonging to HCMS should be rendered two years service in the rural areas out of a total three years services. However, the conditions of rural service will not be applicable in the case of member of HMES.

ii. There should be nothing adverse against his integrity and efficiency.

iii. His service can be spared by the employer for the duration of the course without adversely effecting larger public interest.

iv. In addition to the above if a Doctor has already studied for PG Diploma course in any subject under the Government Scheme as in service candidate, he will be considered for grant of No Objection Certificate” only for the PG Degree Course in that very discipline/subject provided he has completed the period of bond/bank guarantee executed by him while proceedings for the diploma course.

v. The in-services candidates, who already have a PG Degree to their credit in any subject and want to do a diploma course in the same subject on in any other subject will not be considered for issuance of NOC.

vi. A Doctor, who has completed PG Diploma course in any subject and wants to go in for PG Degree course in a subject other than the one in which he had done the diploma, will not be considered for “No Objection Certificate”.

vii. A Doctor, who has a PG Degree to his credit, will be considered for super in the same stream.


2. After the NOC is issued to the applicant, his admission will be governed by the admission rules of the institution/University.


3. Once a candidate who has been granted NOC for admission on Higher Study against the open seats, succeeds in getting admission to the said course, he will be required to take the following steps.


i) He will have to apply for the leave of kind dye under the rules under the rules for the duration of the course of study the leave period will be considered for the duration of the course as prescribed by the competent authority.

ii) Consequent upon sanction of leave and before his relieving from the Department he will have to submit a bank guarantee of Rs. 7 lacs in the case of Degree Course and Rs. 5 lacs in case of Diploma Course. He will serve the Government of Haryana for the period of minimum period of 7 years for PG Degree/Super Specialty and for a minimum period of 5 years in case of PG Diploma Course.

F. Consequences of failure to complete the course of study within the prescribed period or leaving the same mid-way.

i) In case the services candidate fails to complete the course of study within the prescribed period, he shall be allowed to avail a maximum of three more chances to complete the same. The period taken in completion of course beyond the prescribed period may be allowed as EOL will not be counted as service for any purpose e.g. increments, grant of Higher Standard scales 1 linked with service period, pension etc. ii) “In case the employee concerned leaves the course of study mid way without completing the same to the satisfaction of the institution for reasons, whatsoever he will be liable to refund the amount he would have received on a account of study leave to the Government and the period from the date of relieve viz form the Government service till the date of joining shall be treated as period from the date of relieve viz form the Government service till the date of joining shall be treated as period of extra ordinary leave without pay unless he has been incapacitation on medical grounds and the medical institution certificates the fact of incapacitation and recommend the exemption of the above. Further, this period of EOL shall not count as service for any purpose e.q. position etc. The employee concerned will also be debarred for a period of five years for NOC for Higher Studies”.


Stipend/Fellowship:-


1. Candidates sponsored against reserved seats.
Stipend is paid to PG Diploma/Degree course students in the PGIMS Rohtak. The candidates admitted to PG Diploma /Degree courses against eh receive any amount on account of stipend so long as they are on half pay study leave. However, the in-service candidate will be entitled to received the stipend at the rates in force time to time for the period of EOL, without pay during the course of study. Further, the candidates under this category will have the option to either receive the full pay/half pay as admissible under the case of stipend admissible is more beneficial to them, they may avail EOL instead of study leave for the duration of the course of study. Option once exercised will not be allowed to be changed.

2. Candidates admitted to Higher Courses of Study against open seats:-
The admissibility of half pay in lieu of study leave on the stipend in case of in-service candidates admitted to PGIMS Rohtak in this category will be the same as provided above in the case of candidates admitted against reserved seats. The candidates admitted against reserved seats. The candidates admitted to PG Diploma/Degree/Super Specialty course against the open seats in institution other than PGIMS Rohtak and under going the same by availing of leave of kind due including study leave, will be entitled to receive the stipend/fellowship amount that may be payable by the institution during the course period in addition to the emoluments he may be entitled to receive on account of study leave.


H. Treatment of unutilized reserved seats.
Seats reserved in the PGIMS Rohtak for the HCMS Doctors in various PG Diploma/Degree courses to the extent the same remain unutilized from among the HCMS may be available for the open candidates on year to year basis.

This policy is subject to the amendment in the CSR Volume 1 Part II (Appendix – 20)

Subject: Policy regarding higher studies of Doctors in the Department of Health and Medical Education.

Sir,
I have been directed to invite your attention to the subject mentioned above and to state that the admission of HCMS and HMES doctors for Higher Studies leading to Diploma PG Degrees/Super circulated by the Health and medical Education Department vide memo No. 18/94/96-IHBI dated 4.3.1999. The Government has now taken a general policy decision in this behalf circulated by the Finance Department vide its instructions bearing no. 10/6/99-3FR-II dated 10.10.2001. A need has arisen to formulate a new policy in respect of the employees of the Department of health and medical education in furtherance of the general policy announced by the State Government vide its instructions dated 19.10.2001. Accordingly, in supercession of the policy dated 4.3.1999 issued by the Heath and Medical Education Department, and in furtherance of the Government policy of 10.10.2001, a new policy as detailed below is introduced with immediate effect. The General guiding principles laid down in the Government policy circulated vide instructions bearing no. 10/6/99-3FR-11 dated 19.10.2001 shall remain valid for the purpose of this policy.

A General
1. HCMS/HMES doctors serving in connection with the affairs of the State Government in the Health Department and those serving the PGIMS, Rohtak may be allowed to apply for and seek admission in various academic courses leading to PG Diploma/PG Degree/Super Speciality Courses in their respective streams of Medical profession for which they will have to apply for and avail study leave in accordance with the precision contained under Rule B. 126 of the CSR Vol. 1 part read with Appendix 20 contained in CSR Vol. 1 part II or leave of the kind due as admissible under the rules.

2. Permission to go in for higher studies to the in service candidates is not a matter of right. It will be subject to specific approval by the Government which will be dependent upon various facts e.g. possibility to spare one’s service without adversely affecting the larger public interest, the felt needs for specialists in various disciplines in the basis of a review carried out fro time to time and other exigencies of service.

3. Study leave is admissible on half pay for a maximum period of 24 months in the entire service career but if can also be combined with leave of the kind due/ordinary leave for study purposes subject to a maximum limit of five years in the entire service career.

4. The basic condition of entitlement of study leave is 5 years service Ad hoc service followed by regular service and counted for the purpose of increment shall be taken into account while calculating the requisite length of service.

5. In the event a candidate is keen to go on for higher studies but does fulfill the prescribed length of service as required for study leave, he can be considered for the same provided he compared three years service. However, in such cases, the employees concurrent shall have to apply for and avail of extra-ordinary leave without pay for the period of study in all other case, the employees concurrent will have to resign from service for the purpose of pursuing higher studies.

6. Study leave shall not ordinarily be granted in the case of an employee who is due to retire or has to the option to retire from Govt. service within 5 years of the date on which he expected to return to his after completion of his course.
7. The requisite length of service shall be calculated as on the last date of submission of application for the relevant course (s).

8. The period of study leave of the kind due take for purpose of higher as admissible under the rules shall count as service for all purpose subject to the condition of successful completion of the course of study within the prescribed period. The period of EOL also taken for the purposes of higher studies may also be allowed to count towards service for the purpose of increments and pension at the discretion of the competent authority.

B. Procedure
The procedure for availing of the opportunity of higher studies under this policy would be as under:-

Presently, certain number of seats are reserved in the PGIMS, Rohtak for PG Diploma/P.G. Degree Course for the service employees of HCMS. The cases of in service candidates for higher studies against reserved seats will be regular as followed:
1. Candidates keen to go in for the P.G. Diploma/P.G. Degree Courses against the reserved seats will be required to apply for a No Objection Certificate to the competent authority before submitting their applications for admissions to the said course. Only those candidates will be considered for NOC under this category who fulfill the following conditions:

i) He/she must have completed the probation period successfully completed 5 years service under the State Government including the probation period out of which three years service should be in rural area/service.
ii) There should be nothing adverse against his integrity and efficiency.
iii) His service can be spared by the employer for the duration of the course without adversely affecting the larger public interest.
iv) In addition to the above, if a doctor has already for a P.G. Diploma Course in any subject under the Government Scheme as an in service candidate, he will be considered for grant of No Objection Certificate only for the PG Degree Course in that very discipline subject provided he has completed the period of bond executed by him while proceedings for the Diploma Course.
v) The inservice conduits who have a PG Degree to their credit in any subject and want to do a Diploma Course in the same subject or any other subject, will not be considered for issuance of NOC.
vi) A doctor who has completed a PG Diploma Course in any subject and wants to go in for P.G. Degree Course in a subject other than the one in which he has done the diploma, will not be considered for No Objection Certificate.

2. After the NOC is issued to the applicant, has admission will be governed by the admission rules of the institution/university. However, the candidate will have to appear for the common entrance test conducted for admission to the relevant course and obtain a minimum of 50% marks in order to be eligible for admission to the course.
3. Once the candidate sponsored against the reserved seats succeeds in getting admission to the said course, he will be required to take the following steps.

i) He will have to apply for the study leave/leave of the kind due for the duration of the course of study, the leave period will be considered for the duration of the course as prescribed by the institution.
ii) Consequent upon sanction of leave and before his relieving from the department, he/she will have to execute a bond in the form prescribed and annexed to Appendix 20 of the CSR vol. 1, and part II to the effect that he shall serve the Government to Haryana for a minimum period of 7 years or pay an amount of Rs. 7.00 lacs to the Haryana Government in lieu thereof in case of a PG Degree Course, and for a minimum period of 5 years or payment of an amount of Rs. 5.00 lakhs in lieu of thereof in the case of a PG Diploma Course.

D. Consequent of failure to complete the course of study within the prescribed period or leaving the same mid-way.

i) In case the sponsored candidates fails to complete the course of study within the prescribed period, he shall be allowed to avail of a maximum of three more changes to complete the same. The period taken in completion of the course beyond the prescribed period may be allowed as EOL without pay but this extended period of EOL will not count as service for any purpose e.g. increments, grant of higher standard scales linked with service period, pension etc.

In case the employee concerned leaves the course of study mid-way without completing the same to the satisfaction of the institution for reason, whatsoever, he will be liable to refund the amount he would have received on account of Study leave to the Government and the period from the date of relief from the Government service till the date of joining shall be treated as period of Extra-ordinary leave without pay, further this period of EOL shall not count as service for any purpose e.g. increments, grants higher standards scales linked with service period, pension etc. The employee concerned will also be debarred for a period of five years for NOC for higher studies.

Diploma Course in any subject under the Government Scheme as an in service candidate, he will be considered for grant of No Objection Certificate only for the PG Degree Course in that very discipline subject provided he has completed the period of bond executed by him while proceedings for the Diploma Course.
v) The in-service conduits who have a PG Degree to their credit in any subject and want to do a Diploma Course in the same subject or any other subject, will not be considered for issuance of NOC.

vii) A doctor, who has a PG Degree to his credit, will be considered for super-speciality course in the stream.

3. Once the candidate, who has been granted NOC for admission to higher courses of study against the open seats, succeeds in getting admission to the said course, he will be required to taken the following steps.

i) He will have to apply for the study leave/leave of the kind due for the duration of the course of study. The leave period will be considered for the duration of the course as prescribed by the institution.
ii) Consequent upon of leave and before his relieving from the department, he will have to execute a bond in the form prescribed and annexed to Appendix 20 of the CSR vol. 1, and part II to the effect that he shall serve the Government to Haryana for a minimum period of 7 years or pay an amount of Rs. 7.00 lacs to the Haryana Government in lieu thereof in case of a PG Degree Course, and for a minimum period of 5 years or payment of an amount of Rs. 5.00 lakhs in lieu of thereof in the case of a PG Diploma Course.

F. Consequent of failure to complete the course of study within the prescribed period or leaving the same mid-way.

i) In case the in-service candidates fails to complete the course of study within the prescribed period, he shall be allowed to avail of a maximum of three more changes to complete the same. The period taken in completion of the course beyond the prescribed period may be allowed as EOL without pay but this extended period of EOL will not count as service for any purpose e.g. increments, grant of higher standard scales linked with service period, pension etc. ii) In case the employee concerned leaves the course of study mid-way without completing the same to the satisfaction of the institution for reason, whatsoever, he will be liable to refund the amount he would have received on account of Study leave to the Government and the period from the date of relief from the Government service till the date of joining shall be treated as period of Extra-ordinary leave without pay, further this period of EOL shall not count as service for any purpose e.g. increments, grants higher standards scales linked with service period, pension etc. The employee concerned will also be debarred for a period of five years for NOC for higher studies.

G. Stipend/Fellowship.

1. Candidates sponsored against Reserve Seats.
Stipend to paid to PG Diploma/Degree Course student in the PGIMS, Rohtak. The candidates admitted to PG Diploma/Degree Courses against the reserved sets, and undergoing the same by availing of study leave, will not be entitled to get any amount on account of stipend so long as they are on half pay study leave. However, the in-service candidate will be entitled to receive the stipend at the rates in force from time to time for the period of EOL without pay during the course of study. Further, the candidates under the category will have the option to either receive the half pay as admissible under the study leave rules on the stipend admissible in PGIMS, Rohtak, whichever is beneficial top them. In case the rate of stipend admissible more beneficial to them, they may avail of the EOL instead of study leave for the duration of the course of study. Option once exercised will not be allowed to be changed.

2. Candidates admitted to higher courses of study against open seats.
The admissibility of half pay in lieu of study leave on the stipend in case of in-service candidates admitted to PGIMS, Rohtak in this category will be same as provided above in the case of candidates admitted to PG Diploma Degree/Super-Speciality courses against the open seat in institutions other than PGIMS, Rohtak and undergoing the same by availing of leave of the kind due including study leave, will be entitled to receive the stipend/fellowship amount that may be payable by the institution during the course period in addition to the emoluments he may be entitled to receive on account of study leave.

H. Treatment of utilization reserved seats
Seats reserved in the PGIMS Rohtak for the HCMS doctors in various PG Diploma Degree Courses, to the extent the same remain unfilled form among the HCMS, may be availed for the open candidates on year to year basis.
The above policy may be brought to the notice of all concerned.

2. Request for clarification has been received from some quarters about the State Govt. Instructions issued vide letter No. 18/94/96-IHBI dated 21.12.1996 amending certain provisions of the earlier policy. Notwithstanding anything contained earlier instructions in this regard the following criteria shall be apply for seeking NOCs/sponsorship for different courses.

3. It is clarified that only these doctors should be considered eligible for giving No Objection Certificate for doing MS/MD/diploma courses, who fulfill the following conditions.

I. Reserved Seats (MD/MS/Diploma)

a) Has been appointed on regular basis, has completed the probation period and has been completed the 3 years, but out of which, 2 years services should be in Rural area and he should have nothing adverse in this regard to his efficiency and integrity.

Period spent on ad hoc basis in the State followed by Regularization and services in Rural area of the State will be counted towards the service of 3 years and 2 years from Rural Service.

While calculating the 3 years and 2 years service, period spent on probation shall be counted, but any period on extra ordinary leave, leave without pay etc. will not be counted.
b) The doctor while doing the course will be treated on duty and will be paid full pay and allowance for the duration of the course.

II. OPEN SEATS
Had been appointed regulars basis, has completed probation period, there is nothing adverse regarding efficiency and integrity and has 3 years service in the State out of which he should have completed 2 years in Rural service in the State.

The period spent on the ad hoc service in the State and in the Rural Area in the State will be taken in to account for the purpose of counting the period of 3 years and 2 years rural services respectively.

While calculating the above said period of 3 years and 2 years the period spent on probation shall be counted, but any period spent on extra ordinary leave or leave without pay etc. will not be counted.

He will be granted extra ordinary leave for the duration of the MD/MS Diploma Courses if he receives stipend/sponsorship from the concerned institute, however, if he does not received any stipend/scholarship from the concerned institute, he will be allowed save of the kind due.

3. All other HCMS Doctors, who are not covered under the above categories will be issued No Objection Certificate for doing MD/MS/Diploma Courses in Pandit B.D. Sharma PGI Medical Science, Rohtak and other medical Institute of the country on the condition that they have to resign from service in case they are selected for the courses.

4. In addition to the above if a doctor has already done diploma course in any subject, he will be considerable for grant of No Objection Certificate against the reserve and open seat provided the fulfilled the above mentioned criteria and the period of bond executed by him while doing diploma has been completed. The doctors who have already done MD/MS/Diploma courses in any subject and want to do diploma courses in the same subject or any other subject will not be considered. A doctor who has done diploma in any of subject other than in which he has done the diploma, will not be considered for No Objection Certificate.

5. After the issue of the “No Objection Certificate” against reserve seats, the doctor will have to appear in the common entrance test to be conducted by the Competent Authority notified by the Govt. and will have to obtain atleast 20% marks. The last date of the receipt of the application will be cut of date of the calculating service.

6. There will be no interview for PG Course. There will be only written examination.

7. Super Speciality Courses
A Doctor will be considered eligible for consideration for giving a No Objection Certificate/sponsorship Certificate (A Reserve Seat) for superspeciality Courses (MD etc) if he has rendered 10 years of service with the Haryana Govt. after doing his post graduation course, during the period of course, he will be treated on deputation and paid full emoluments for open seats, he will be allowed extra ordinary leave, he will also execute a bond to serve the state for 5 years or to pay Rs. 10 lacs in Govt. Treasury.

Note: This criteria will also be applicable to the doctors ----- PGIMS, Rohtak.
In this case 10 years service will be -------- Pt. B.D.S, PGIMS, Rohtak provisions of rural service will not be insisted on.

8. The course period for MD/MS/DM will be only two years beyond which the person will not be considered on duty.

9. No change of subject will be permitted during the course.

10. A doctor in the State (For health as well as Medical Education Department) before being relieved for any post graduation super speciality course will execute a bond for serving the State (in HCMS Cadre) for 5 years on to pay Rs. 10 lacs in Govt. Treasury in lieu thereof. Before being relieved for any diploma course, he will have to execute a bond to serve the State (in HCMS Cadre) for 10 years or to pay Rs. 3 lacs in Govt. Treasury in lieu thereof.

11. It is also in emphasis that grant of NOC/sponsorship certificate is not a matter of right. The Govt. shall see the feasibility of each and every case on merit after a particular employee fulfills the eligibility criteria given before taking a decision in public increase and administrative constrain.
